License Agreement

This License Agreement ("License") applies to every design purchased or downloaded from upfinityco.com. It is included with every purchase at no extra cost and forms part of our Terms of Service.

Summary

You may:

Print the design for personal use as many times as you like.
Give prints as gifts.
Sell physical prints with no additional fee and no limit on the number of prints, subject to the restrictions below.
Modify the files for your own printing.

You may not:

Share, sell, give away or upload the files, in original or modified form.
Use the files for print farms, outsourced production, wholesale or mass manufacturing.
Use Upfinity photos, videos or renders to sell your prints.

This summary is for convenience only. The full terms below apply.

1. Definitions

"Upfinity", "we", "us" means EVERSTONE A2N LLC, operator of upfinityco.com.
"You" means the individual, or the single business entity, that paid for the order. A business licensee may allow its owners and employees to use the files only within the limits of this License.
"Files" means any digital files supplied with a product, including STL, 3MF and other formats, and any modified versions of them.
"Design" means the three-dimensional work represented by the Files.
"Prints" means physical objects produced from the Files by 3D printing.
"Print farm" means any operation that uses more than 10 3D printers in total to produce Prints of our Designs.

2. Ownership

All Designs, Files, photos, videos, renders and product descriptions are original works owned by EVERSTONE A2N LLC and are protected by copyright. A purchase grants you a license only. All rights not expressly granted in this License are reserved by us. Modifying a File does not give you any ownership rights in the Design.

3. License grant

Subject to your payment and your compliance with this License, we grant you a non-exclusive, non-transferable, non-sublicensable, revocable license to download the Files and to produce Prints from them using 3D printers that you own or operate yourself.

4. Permitted uses

Producing Prints for personal use, without limit.
Giving Prints as gifts.
Selling Prints in any quantity through any sales channel, including online marketplaces, your own website, social media, markets, fairs and shops you operate.
Producing Prints to order for your own customers, provided you print them yourself on your own printers.
Modifying the Files for your own printing (for example scaling, splitting, mirroring, repairing, adding holes, text or names, or changing colors) and selling Prints made from those modified Files.
Painting or finishing Prints and adding non-printed components before selling them.

5. Prohibited uses

You may not, directly or indirectly:

share, sell, rent, lend, give away, upload or otherwise distribute the Files, or any modified version, remix or derivative of them, in any digital form or through any platform, including file-sharing sites, marketplaces, model repositories, cloud folders, messaging apps, bundles, subscriptions, NFTs or print-on-demand services that give customers access to the Files;
share your download links or account access with anyone;
operate a Print farm using our Designs, or have Prints produced by any third party, including print services, factories or printers you do not operate yourself;
sell Prints wholesale to retailers, distributors or resellers, or produce stock for them;
reproduce the Design by molding, casting, injection molding or any other mass-production method;
use Upfinity photos, videos or renders to advertise or sell your Prints;
claim the Design as your own, or register any copyright, design, trademark or other right in the Design or in any work based on it;
use the Files, photos or renders to train, fine-tune or operate artificial intelligence models, or to generate 3D models or images for distribution;
transfer or assign this License to anyone else.

6. Product-specific terms

Some products may be subject to additional or different terms. These are stated clearly on the product page and apply to that product in place of any conflicting term in this License.

7. Extended licenses

Uses not permitted by this License, including Print farms and wholesale, require a separate written agreement. To request one, email upfinity.com@gmail.com with the subject "Farm License".

8. Attribution

Attribution is not required. Where you choose to credit us, please use "Designed by Upfinity" and a link to upfinityco.com. You may not suggest that we endorse or sponsor your products or business.

9. Proof of purchase

If you sell Prints, you must be able to provide proof that you lawfully purchased the Files from Upfinity, such as your order number, when requested by us or by a marketplace or payment provider. Prints made from Files obtained from any other source are not licensed.

10. Your responsibility for Prints

You are solely responsible for the Prints you make and sell, including their quality, safety, labeling and compliance with all applicable laws and marketplace rules, such as product safety rules for items intended for children and food-contact regulations. Our Designs are intended as decorative and hobby items unless a product page states otherwise.

11. Termination

This License ends automatically if you materially breach its terms and do not have a continuing legal right to use the Files.

If payment for a purchase is refunded, reversed, cancelled or successfully charged back, the License ends for the Files covered by that refunded or reversed purchase, unless otherwise required by applicable law.

A payment dispute that is merely pending does not by itself permanently terminate the License, although we may temporarily suspend download access while the dispute is being investigated.

When a License ends, you must stop producing new Prints from the affected Files, stop using the affected Files for commercial purposes, stop advertising or selling any Prints made from the affected Files, and delete all copies of the affected Files, subject to any rights that applicable law does not allow us to restrict.

Sections 2, 5, 10, 11, 12 and 14 continue to apply after termination where legally applicable.

12. Enforcement

We monitor for unauthorized use of our Files and Designs. In the event of a breach, we may disable your downloads and account, submit takedown notices to marketplaces, platforms and payment providers, and pursue all legal remedies available to us, including claims for damages and recovery of legal costs.
